These terms govern every purchase you make from holygrailbookshop.com. By placing an order, you accept them in full.
1. Who we are
Holy Grail Bookshop is operated by BAZELLAND BV, a private limited company (besloten vennootschap) registered in Belgium under company number 0471.764.646, VAT BE 0471.764.646, with registered office at Welvaartstraat 54A bus 4, 2000 Antwerpen, Belgium. You can reach us by email at info@holygrailbookshop.com or by telephone on +32 488 38 41 87 during business hours. In these terms, “we”, “us” and “our” refer to this entity; “you” refers to the customer.
2. What we sell
We sell digital collections of historical works — texts of the Western esoteric, philosophical, mystical, and historical canon — assembled, organised, and delivered as downloadable archives. Each collection is a single sale at a fixed price. Nothing physical is shipped. Nothing is delivered on a tangible medium.
3. The contract
A binding contract is formed between you and us when (a) you complete checkout by clicking the Order with obligation to pay button, (b) your payment is authorised by the payment processor, and (c) we send you the order confirmation by email. Until all three conditions are met, no contract exists and we may refuse the order at our discretion.
4. Pricing and VAT
All prices are shown in euro. For sales to consumers within the European Union, the price shown at checkout includes the VAT applicable in your country of residence, calculated under the EU One-Stop Shop scheme. Prices may change at any time, but never retroactively for orders already placed.
For business customers established in another EU Member State who provide a valid VAT identification number at checkout, we apply the reverse-charge mechanism: no Belgian VAT is invoiced and you account for VAT in your own country.
5. Payment
Payment is processed by WooPayments, Stripe, or PayPal — whichever you select at checkout. We do not see, store, or hold your card details at any point. By submitting payment, you confirm that the payment method belongs to you and that funds are available.
6. Delivery
Delivery is digital and immediate. After successful payment you will receive (a) an order confirmation email containing your download link(s), and (b) a corresponding download in your customer account if you have created one. Links may be re-issued from your account at any time. We are not liable for emails caught by spam filters or rejected by your email provider — check your spam folder before contacting us.
7. Right of withdrawal — please read carefully
EU consumer law normally gives you a 14-day right to withdraw from an online purchase without giving any reason. There is a specific exception for digital content not delivered on a tangible medium where you have asked us to begin the download immediately, and have acknowledged that you thereby lose the right of withdrawal.
To rely on that exception, three things happen during checkout:
- You tick the checkbox placed directly above the order button. It reads: “I expressly request immediate performance of the contract — i.e. instant access to my download — and I acknowledge that I thereby lose my statutory 14-day right of withdrawal once the download has been delivered.”
- You click the order button labelled Order with obligation to pay.
- We confirm your express consent and acknowledgement in the order confirmation email we send you.
Once all three steps are complete, the right of withdrawal no longer applies and all sales are final. The download is considered delivered as soon as the link has been generated and sent to your email address.
If a technical fault prevents you from accessing the download — and we cannot resolve it within a reasonable time — we will refund the purchase in full.
If, for any reason, the exception above does not apply to your order (for example because the checkbox was not ticked), you keep the standard 14-day right of withdrawal. To exercise it, send us an unambiguous statement by email at info@holygrailbookshop.com — you may use the model withdrawal form attached as Annex 1, but you are not required to.
8. Statutory conformity guarantee
As a consumer, you benefit from the statutory two-year conformity guarantee on digital content provided under Belgian law (which implements EU Directive 2019/770). If the content you receive does not conform to what was agreed — for example, files are corrupted, incomplete, or do not match the description on our website — you may demand free remedy, a proportionate price reduction, or, in case of substantial non-conformity, termination of the contract. To make a claim, contact us at info@holygrailbookshop.com with a description of the issue. Nothing in these terms restricts these statutory rights.
9. Licence granted to you
We grant you a personal, non-exclusive, non-transferable, perpetual licence to download, store, read, print, annotate, and reference the purchased collection for your own private, educational, or research use. The licence is granted to you as the named purchaser. It cannot be sub-licensed, lent, or assigned.
10. What you may not do
You may not: (a) resell, sub-licence, or commercially redistribute the collection, in whole or in part; (b) upload the archive to any public file-sharing, torrent, mirror, or aggregator service; (c) re-package our curated arrangement as your own product; (d) remove or obscure any notice, logo, or identifier we include in the delivery; (e) use the collection in any way that violates the laws of your jurisdiction.
Our curatorial selection, ordering, and packaging are protected by copyright and by the sui generis database right as a compilation work, even where the underlying texts are not. Breach of this section terminates your licence immediately, without prejudice to any other remedy we may have.
11. Disclaimer regarding the contents of the books
The works in our collections are historical documents. They were written by their respective authors, in their respective eras, reflecting the views, beliefs, ideologies, and prejudices of those authors and eras. We do not endorse, advocate, recommend, or share any view, belief, ritual, instruction, ideology, theory, or claim contained in any book we distribute.
Books are sold strictly for educational, historical, scholarly, and research purposes. Their inclusion in a collection is not an endorsement of their contents. Some collections contain works whose subject matter is dark, disturbing, occult, magical, religious, political, or otherwise sensitive. Engagement with these works is your decision and your responsibility.
Nothing in any book is medical, legal, financial, psychological, or professional advice of any kind. Do not treat it as such. If you need professional advice, consult a qualified professional.
12. Your jurisdiction is your responsibility
Copyright law differs from country to country. A work that is freely distributable under European Union law may still be restricted under the laws of your country. By placing an order, you confirm that you are responsible for verifying that your purchase, your download, and your subsequent use of the collection comply with the laws of the jurisdiction in which you reside. We sell from Belgium under Belgian and EU law. We make no representation about the legality of any work in any other jurisdiction.
13. Warranty disclaimer
To the maximum extent permitted by law — and without prejudice to the statutory conformity guarantee in Section 8 — we deliver the collections “as is” and “as available”. We do our utmost to verify provenance, attribution, and edition dates, but we do not warrant that every detail is correct. If we have made a mistake, the notice procedure in Section 17 applies.
Where statutory consumer rights cannot be excluded under the mandatory law of your habitual residence, those rights apply notwithstanding this section.
14. Limitation of liability
To the maximum extent permitted by applicable law, our total aggregate liability arising from or in connection with any order, the website, the collections, or these terms is limited to the amount you paid for the order in question, except in cases of intent, gross negligence, or breach of an essential obligation. We are not liable for indirect, consequential, incidental, special, or punitive damages.
Nothing in these terms limits our liability for (a) death or personal injury caused by our negligence, (b) fraud or fraudulent misrepresentation, or (c) any other liability that cannot be limited or excluded under Belgian or EU mandatory consumer law.
15. Your responsibilities and indemnification
You agree to comply with the licence granted in Section 9 and the restrictions in Section 10. If you breach those provisions — including unauthorised redistribution, mirroring, or commercial use of a collection — you are responsible for the consequences of that breach, and you will hold us harmless from any third-party claim that arises directly out of it. This obligation applies in addition to, not in place of, the statutory consumer rights you enjoy.
For business customers (B2B), a broader indemnification applies: you agree to indemnify and hold us harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising from your breach of these terms, your unauthorised use of any collection, or your acts in any jurisdiction whose laws differ from those under which we sell.
16. Force majeure
We are not liable for any failure or delay in performance caused by an event that was unforeseeable at the time of contracting and that lies genuinely beyond our reasonable control, including acts of God, war, terrorism, civil unrest, governmental action, or pandemic. Routine third-party service issues (hosting outages, payment-processor downtime, transactional-email failures) are not automatic force majeure; we will treat them as our own operational responsibility and refund affected orders if delivery cannot be completed within a reasonable time.
17. Copyright notice and takedown
If you believe a work in any of our collections infringes a copyright you own or are authorised to enforce, write to info@holygrailbookshop.com with (a) identification of the work, (b) the URL of the offering, (c) evidence of your rights, and (d) a statement made in good faith that, to the best of your knowledge, the use is not authorised. We will investigate promptly and, where the claim is substantiated, withdraw the work and refund affected purchasers. Knowingly making a false claim may constitute fraud or defamation under Belgian law.
18. Changes to these terms
We may amend these terms from time to time. The version that applies to your purchase is the version published on this page at the moment your contract was formed. We will not retroactively apply new terms to past purchases without your consent. The last-updated date is shown at the top of this page.
19. Severability and entire agreement
If any provision of these terms is found unenforceable, the remaining provisions remain in full force. These terms, together with our Privacy Policy, our Licensing & Sources page, and the order confirmation we send you, constitute the entire agreement between you and us in respect of any purchase, and supersede all prior communications.
20. Complaints and dispute resolution
We aim to resolve every complaint amicably and quickly. Please contact us first at info@holygrailbookshop.com — we respond within five working days.
If we cannot reach an agreement, you may submit the dispute to the Belgian Consumer Mediation Service (Consumentenombudsdienst), free of charge, in any official Belgian language. We are not obliged to participate in any alternative dispute-resolution procedure, but we will engage constructively if you choose to use one.
21. Governing law and jurisdiction
These terms are governed by the laws of Belgium, without prejudice to the mandatory consumer-protection law of your habitual residence. The courts of Belgium have jurisdiction over any dispute arising from or in connection with these terms; consumers may also sue in the courts of their own country of residence, and we may only sue you in the courts of your country of residence.
22. Editorial and website content
The design, text, layout, and curatorial arrangement of this website are protected by copyright and by the database right; reproduction beyond what is permitted by law requires our written consent. Where this website links to external pages, we have no control over their contents and accept no responsibility for them.
